Terms Of Service 

This policy defines the Terms of Service all BizWizWebz customers agree to when they sign-up for any BizWizWebz service.

BizWizWebz reserves the right to change, amend or revise any portion of this policy at any time, without advance notice to customers.

Customers using any services offered by BizWizWebz agree to be obligated by and must comply with all policies in this Term of Service. BizWizWebz retains the sole discretion to make judgment regarding any violation by any BizWizWebz customer and may take action against any customer deemed to be in violation of these terms including the cancellation of any customer services without refund and/or, if deemed appropriate, be legally prosecuted.

BizWizWebz services, including all related equipment, networks and network devices are provided only for authorized customer use. BizWizWebz systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of BizWizWebz system(s) constitutes consent to monitoring for these purposes.

Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. BizWizWebz may, at its discretion, request and require documentation to prove access to a third party network or system is authorized.

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.

Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via troubleticket/email and will have a response within 48 hours.

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography:

Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.

Violations will be reported to the appropriate law enforcement agency.

Payment Information:
Full payment is required in advance before hosting service is established, which includes renewals and domain registration/renewal.  Half down payment is required before any custom website design or development service is rendered with full payment required before site becomes "live" or files are provided/transferred. You warrant and represent that the information you supply in the Order Form (or other information that BizWizWebz may require) is accurate and truthful. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. If payment was not received by the due-date, your account will be suspended. To have your account re-established, you will need to pay the monthly fees, plus a late payment fee.

Customer agrees to supply appropriate payment for the services received from BizWizWebz, in advance of the time period during which such services are provided. customer agrees that until and unless notification to BizWizWebz of the desire to cancel any or all hosting services is received, those hosting services will be billed on a recurring basis.

We require that cancellations of service are done through the online Cancellation Form to (a) confirm your identity, (b) confirm in writing you are prepared for all files/emails to be removed, and (c) document the request. This process reduces the likelihood of mistakes, fraudulent/malicious requests, and ensures you are aware that the files, emails, and account may be removed immediately after a cancellation request is processed.

The Cancellation process can be performed by logging in to your Client Area account. Once in the client area click "SERVICES " on the main menu. You will be taken to "My Products & Services". On the "My Products & Services" page click the name of the "Product/Service" package that is directly above your website domain name. Once on the "Product Details" page you will find in the bottom of the left column "Request Cancellation" which you will need to click. On the "Account Cancellation Request" page that follows submit a short description under"Briefly Describe your reason for Cancellation" ". Next from the "Cancellation Type" drop down arrow choose either "Immediate" or "End of Billing Period" depending on your need and then click the red "Request Cancellation" button to complete the Cancellation.

Retaining or transfer of client domain(s) once service canceled:
All domains purchased by client may be retained by the client either in continuing to pay for an annual domain renewal fee or by having the domain transferred to another domain host/registrar. There will be a fee for the transfer of any domain to another domain host/registrar. The domain transfer fee is determined by and will take 7 business days before the domain may become available for the transfer.

Account Setup / Email on file:
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.

Transfers to Our Service:
Our transfers team will make every effort to help you move your site to us. However, transfers are provided as a courtesy service, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Previous host must be set with and managed by cPanel. We will need the log in information to access your domain's cPanel. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases we may be unable to assist you in a transfer of data from an old host.

The free transfer services are available for 15 days from your sign up date. Transfers outside of the 15 day free period will incur a charge; please contact the with specific details to receive a price quote.

Backups and Data Loss:
Except where the Provider has expressly agreed in writing to the contrary, Customers are solely and entirely responsible, and BizWizWebz is in NO way responsible for the management and backup of any Customer data. Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. BizWizWebz is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on BizWizWebz servers. Backups will not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing by BizWizWebz.

Customer agrees that it shall defend, indemnify, save and hold BizWizWebz harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against BizWizWebz, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless BizWizWebz against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with BizWizWebz; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from BizWizWebz's server.

BizWizWebz shall not be responsible for any damages your business may suffer. BizWizWebz makes no warranties of any kind, expressed or implied for services we provide. BizWizWebz disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by BizWizWebz and its employees.

BizWizWebz will be the sole and final arbiter as to what constitutes a violation of this policy.
